Family law is the area of law relating to marriage, divorce, post separation support, alimony, child custody and support, equitable distribution (property division), enforcement of support, domestic violence, adoption, and nuptial agreements.

The Herring Mills & Kratt PLLC family law practice group includes four family law attorneys—three of whom are experienced and well-known domestic attorneys who are board certified specialists in family law and concentrate their practices primarily in Wake County. All three family law attorneys are certified as mediators and have active trial practices. Each family law attorney is a frequent speaker at continuing legal education classes and author frequent articles on family law.

Divorce and Family Law

Uncontested matters in family law may include nuptial agreements, guideline child support cases, custody, separation agreements, free-trader agreements and uncontested divorces as well as nuptial agreements and adoption. Premarital and nuptial agreements legally bind the parties to act in specified ways as circumstances arise. For example, a prenuptial agreement may require that one spouse pay the other spouse a specific amount of support upon divorce.

Litigation

The family law litigation areas include: equitable distribution (property division), custody and visitation, child and spousal support, pension division (including military and government pensions), and emergency relief including restraining orders and domestic violence protective orders.

Appeals

We handle appeals to the North Carolina Court of Appeals and to the Supreme Court of North Carolina.

Mediation and Arbitration

Each of the attorneys in the family law practice group has been trained in family law mediation and is an experienced mediator. Even in litigation cases, our family lawyers earnestly attempt whenever possible to settle matters short of court to minimize client’s emotional and financial costs. We use four-way settlement conferences as well as mediated settlement conferences and collaborative law in an effort to try and settle cases in an amicable manner. If litigation is needed to resolve a case, our lawyers are prepared and have the experience to represent your interest zealously.

Family Adoption

The family practice group is unique in North Carolina because of our experience in adoption law, including independent (private) adoptions, interstate adoptions, family and stepparent adoptions, and re-adoption in North Carolina in international adoptions. One of our lawyers is a member of the American Academy Adoption Attorneys and two of our attorneys co-direct a licensed North Carolina child placement agency, A Child’s Hope.
